'Data Protection' Bill Got Cancelled, Need Amendments - Rajeev Chandrasekhar (MP, BJP)

As confirmed by Mr. Rajeev Chandrasekhar— a BJP MP, the Joint Parliamentary Committee (JPC) has redrawn the Data Protection Bill. Mr. Rajeev Chandrasekhar confirmed the announcement at the Global Technology Summit 2020 event organized by Carnegie India.

During a panel conversation on India's regulations for data and privacy, Mr. Chandrasekhar stated:

"The fact there is a joint parliamentary committee that is sitting and going through the bill and discussing it and we've had almost 52 sittings of the committee, it should tell you that the bill in itself is not something that is working. And that the committee is obviously not going to rubber-stamp this bill. It is going to redraw the bill."

Apart from the data protection bill, the panel discussed Facebook's privacy policy and Amazon Web Services.

Understanding the fundamental privacy rights:

The motive of the data protection bill is to safeguard people's information without troubling the digital economy. The committee believes that the bill generally restricts the users' data, which will also impact the digital world economically. It is more to hide or limit data on digital platforms.

Mr. Chandrasekhar also talked about the "user data security and business growth" balance, and addressed the state's right to access any user's data for public welfare and safety.

An intrinsic part of data security is to have a DPA (Data Protection Authority). This authority will ensure that the law is seriously taken for granted.

Besides, people need to understand the rules and regulations of digital platforms. In 2019, The National Institute of Public Finance and Policy (NIPFP) conducted surveys among the different individuals of urban and English-speaking colleges to test how well they understand the privacy policies of digital channels like WhatsApp, Flipkart, Uber, Paytm, and others. The data of the surveys shows, unlike results, on average people scored 5.3 out of 10.

On the privacy policies, Facebook's Claybaugh, stated:

"Despite the challenges of communicating with people about privacy, we do take pretty strong measures both in our data policy which is interactive, in relatively easy-to-understand language compared to, kind of, the terms of service we are used to seeing."

In support of DPA, Mr. Lee who earlier worked for Singapore's Personal Data Protection Commission suggests that the DPA must work as an independent body with the required powers and authority to expedite or discard any requests.
